IV. Scope and amendment of the Terms and Conditions
These Terms and Conditions apply to purchases made in the online store, the use of the online store, the use of the mobile application, and all related services.
The language of the contract is Hungarian. The online store may be available in both Hungarian and English; however, the Hungarian version of these Terms and Conditions shall prevail in the event of any discrepancy or difference in interpretation.
The Operator is entitled to amend these Terms and Conditions unilaterally. Amendments shall enter into force upon publication in the online store. Orders already placed and confirmed shall be governed by the Terms and Conditions in force at the time of placing the order.
By using the online store, the User accepts that system messages related to the operation of the online store, orders, payment and delivery may be sent by the Operator by e-mail.
V. Use of the online store
In the online store, the User may search for products, browse products, add products to the cart, register, and place orders with or without registration, provided that the current functionality of the online store allows this.
The User may use the online store only lawfully, properly and without infringing the rights of third parties or the Operator.
Any activity that endangers, disrupts, overloads or interferes with the operation of the online store, places automated or malicious requests on the system, or aims to obtain, copy or use the database or content of the online store without authorization is prohibited.
The Operator reserves the right to modify any content element, function, product range, price, description, appearance or operation of the online store without prior notice, provided that such modification does not adversely affect already confirmed orders.
VI. Registration and user account
Certain functions of the online store may require registration. Purchases may be made with or without registration, provided that the current functionality of the online store allows this.
During registration, the User must provide true, accurate and their own data. The User is responsible for the accuracy and up-to-date nature of the data provided during registration.
The User must keep the password associated with their user account confidential. The Operator shall not be liable for misuse resulting from the User’s failure to do so, unless such misuse demonstrably occurred due to a reason within the Operator’s sphere of responsibility.
If the Operator becomes aware that the User has provided false data, misused another person’s data, or used the online store in an unlawful, misleading or abusive manner, the Operator is entitled to restrict, suspend or delete the registration, and to cancel or refuse any pending order.
VII. Provision of real data and abusive orders
When placing an order, the Customer must always provide true, accurate, reachable and their own data. This applies in particular to the following data:
- name or company name,
- billing address,
- delivery address,
- e-mail address,
- telephone number,
- tax or invoicing data, where required.
In the event of an order placed with false, incomplete, misleading, unreachable data, or with another person’s data, the Operator is entitled to cancel the order, refuse service, and restrict or delete the user account.
The Customer acknowledges that the Operator shall not be liable for any delay, failed delivery, additional cost or other consequence resulting from an incorrectly provided e-mail address, telephone number, delivery address or other data.
The Operator reserves the right to fulfil future orders only with advance payment in the event of abusive, intentionally uncollected, fictitious or bad-faith cash-on-delivery orders.
If the Customer does not collect a cash-on-delivery order and the Operator incurs delivery, return delivery or handling costs as a result, the Operator is entitled to make the fulfilment of the next order subject to advance payment.
For fraud prevention, IT security, prevention of abuse and enforcement of legal claims, the Operator is entitled to log technical data related to the order, including in particular IP address, browser data, timestamp, order data and system usage events, in accordance with the Privacy Policy.
VIII. Purchase process
The Customer may add the selected product to the cart by clicking the “Add to cart” button or an equivalent button.
The contents of the cart may be checked, modified or deleted before finalizing the order. Before submitting the order, the Customer must check the contents of the cart, the ordered products, their quantity, prices, delivery and billing data, and the selected payment and delivery method.
The main steps of placing an order are:
- selecting the product,
- adding the product to the cart,
- checking the cart,
- providing delivery and billing data,
- selecting the delivery method,
- selecting the payment method,
- checking the order data,
- finalizing the order with payment obligation.
Submitting the order entails a payment obligation.
After the order has been placed, the system may send an automatic e-mail confirming receipt of the order. This automatic e-mail only confirms the technical registration of the order and does not in itself mean that the sales contract has been concluded.
The sales contract is concluded when the Operator separately confirms the order or begins its fulfilment.
If fulfilment of the order is not possible due to lack of stock, technical error, incorrect data, obvious pricing error, delivery obstacle or other justified reason, the Operator is entitled to refuse or cancel the order. In such a case, any amount already paid shall be refunded.
IX. Correction of data entry errors
Before finalizing the order, the Customer may check and correct the data entered and modify the contents of the cart through the online store interface.
If the Customer notices a data entry error after submitting the order, they must notify the Operator without delay at [email protected].
Depending on the status of the order, the Operator shall attempt to correct the data entry error; however, modification is not always possible if the order has already been handed over, manufactured, is being mixed, or has been dispatched.
X. Products, product information and color display
The Operator makes every effort to ensure that product information, prices, images, descriptions and stock information displayed in the online store are accurate and up to date.
Product images may be illustrations. The actual product packaging, label, shade, manufacturer appearance or certain details may differ from the images displayed in the online store, especially in the case of manufacturer packaging changes or product updates.
Colors displayed on a screen, mobile phone, tablet or monitor may differ from the actual color depending on the device, display settings and lighting conditions. Color samples, color cards, preview images and digital color displays shown in the online store are for information purposes only.
In the case of automotive colors, the final color match may be influenced by several factors, including the vehicle’s year of manufacture, base color, paint technology, previous repairs, fading caused by sunlight, condition of the clear coat, changes in manufacturer formulas and preparation of the surface.
The Customer acknowledges that paint mixed by color code is intended to reproduce the paint according to the factory color code; however, a complete visual match with the vehicle’s current actual color cannot always be guaranteed.
XI. Prices and obvious pricing errors
Prices displayed in the online store are gross prices and include value added tax. Delivery costs are indicated separately during the order process.
The Operator reserves the right to modify prices. Price changes do not affect already confirmed orders, except in the case of an obvious pricing error.
An obvious pricing error includes, in particular, cases where the product price is:
- HUF 0 or unrealistically low,
- clearly displayed incorrectly,
- the result of a system error, technical error or data entry error,
- so significantly different from the general market value of the product that it should be recognizable to the Customer that an incorrect price has been displayed.
In the event of an obvious pricing error, the Operator is not obliged to sell the product at the incorrect price. In such a case, the Operator shall inform the Customer of the error and may offer the product for purchase at the correct price. If the Customer does not accept this, the order shall be cancelled.
XII. Payment methods
The following payment methods are available in the online store:
- online bank card payment through Barion,
- bank transfer,
- cash on delivery,
- cash payment in case of personal pickup,
- bank card payment in case of personal pickup.
1. Barion online bank card payment
Online bank card payment is provided by Barion Payment Zrt. Bank card data are not transmitted to the Operator. Payment is made through Barion’s secure payment interface.
Barion Payment Zrt. is an electronic money institution supervised by the National Bank of Hungary.
2. Bank transfer
If bank transfer is selected, the Customer may pay the order amount to the Operator’s bank account based on the information received after finalizing the order.
Bank: Erste Bank Zrt.
HUF account number: 11600006-00000001-98780649
SWIFT/BIC code: GIBAHUHB
It is recommended to indicate the order ID in the payment reference. The Operator shall begin fulfilling the order after the amount has been received, unless otherwise agreed by the parties.
3. Cash on delivery
If cash on delivery is selected, the Customer pays the order amount upon receipt of the package using the payment method provided by the delivery partner.
If a cash-on-delivery order is refused, intentionally not collected or used abusively, the Operator is entitled to make the fulfilment of future orders subject to advance payment.
4. Payment upon personal pickup
In the case of personal pickup, the Customer may pay at the Operator’s premises by cash or bank card.
XIII. Delivery
The Operator delivers only within the territory of Hungary.
Orders may be delivered through the following delivery partners:
- MPL,
- GLS,
- parcel locker or parcel point, where available for the given order.
Delivery methods, fees and expected delivery times are indicated during the ordering process.
The expected delivery time is generally 1–5 business days; however, this may differ for custom-manufactured products, paints mixed by color code, filled products or products made to order.
The delivery time is for information purposes only. The Operator shall not be liable for delays arising within the delivery partner’s sphere of responsibility, but shall strive to inform the Customer and assist in resolving the issue.
The Customer must provide a delivery address and contact details where receipt of the package can be ensured. The Customer is responsible for failed delivery and additional costs resulting from incorrect or incomplete addressing.
XIV. Receipt of package and damaged shipment
The Customer should, where possible, inspect the package upon receipt. If the packaging is damaged, incomplete, opened or otherwise irregular, the Customer may request that the delivery partner prepare a report.
In case of a damaged package, it is recommended to document the damage with photos, keep the report, and notify the Operator without delay at [email protected].
The absence of a report does not automatically exclude the enforcement of consumer rights; however, it may significantly complicate determining whether the damage occurred during delivery.
XV. Personal pickup
Orders placed in the online store may also be collected personally at the Operator’s premises:
1195 Budapest, Vas Gereben utca 4/d., Hungary
In case of personal pickup, payment by cash and bank card is possible.
Personal pickup does not mean that the Operator operates as a traditional retail store, showroom or retail unit providing product testing. Personal pickup is intended for collecting orders placed through the online store.
The Operator keeps orders prepared for pickup but not collected for a maximum of 30 days. After 30 days, the Operator is entitled to cancel the order, and in the case of Custom Products, to pass on the resulting costs to the Customer where permitted by law.
XVI. Custom products prepared by color code
The CarColor online store offers products prepared by the Operator upon the Customer’s express request, based on an individual color code, RAL code, NCS code, manufacturer color code, VIN-related information or other data provided by the Customer.
Custom Products include in particular:
- automotive paint mixed by color code,
- automotive paint spray filled to individual order,
- touch-up paint, touch-up pen or brush-on touch-up paint,
- paint mixed by RAL or NCS code,
- any product that is not sold by the Operator as a pre-manufactured stock product, but is produced based on the Customer’s instruction.
The Customer acknowledges that after the manufacture, mixing or filling of a Custom Product has started, the order cannot be cancelled, as the product is made according to the Customer’s individual request and cannot be sold unchanged to another customer, or only to a limited extent.
When ordering a Custom Product, the Customer is responsible for the accuracy of the color code, RAL/NCS code, vehicle data, year of manufacture, manufacturer, model, VIN or other data provided.
If the Customer provides incorrect, incomplete or inaccurate data and the Operator prepares the product on that basis, the Operator shall not be liable for the resulting consequences.
The Operator is entitled to request clarification before starting production if the data provided are contradictory, incomplete or professionally unclear.
XVII. Right of withdrawal
A Customer qualifying as a Consumer is generally entitled to withdraw from a distance contract without giving reasons within 14 days from receipt of the product.
Only Customers qualifying as Consumers may exercise the statutory right of withdrawal without giving reasons. Customers acting as companies, businesses, professionals or for business purposes are not entitled to the statutory consumer right of withdrawal.
The Customer may notify the Operator of their intention to withdraw by a clear statement sent to the following e-mail address:
In the event of withdrawal, the Customer must return or personally deliver the product to the Operator without undue delay, but no later than within 14 days of notifying the Operator of the withdrawal:
CarColor 2000 Kft.
1195 Budapest, Vas Gereben utca 4/d., Hungary
The direct cost of returning the product shall be borne by the Customer, unless otherwise stated by the Operator.
After receiving the returned product, or after the Customer has provided credible proof of return shipment, the Operator shall refund the amount paid by the Customer within the statutory deadline, including the cost of the least expensive standard delivery method where required by law.
The Customer is liable for any decrease in the value of the product resulting from use exceeding what is necessary to determine the nature, characteristics and functioning of the product.
The Operator is not obliged to accept packages returned by cash on delivery or postage due.
XVIII. Exceptions to the right of withdrawal
The Consumer may not exercise the right of withdrawal without giving reasons in the case of a non-prefabricated product produced by the Operator on the basis of the Consumer’s instruction or express request, or a product clearly personalized for the Consumer.
Accordingly, the right of withdrawal may not be exercised in particular for the following products:
- automotive paint individually mixed by color code,
- spray filled to individual order,
- custom touch-up paint, pen or brush-on paint,
- paint mixed by RAL or NCS color code,
- paint or paint product prepared according to the Customer’s individual request.
The Customer acknowledges that such products are prepared specifically based on their instructions; therefore, once preparation, mixing or filling has started, the order cannot be cancelled, and the 14-day right of withdrawal without giving reasons cannot be exercised.
This provision does not affect the Customer’s warranty rights arising from defective performance. If the Operator performs defectively, the Customer may enforce the statutory warranty rights.
XIX. Implied warranty
In the event of defective performance, the Operator is liable for implied warranty in accordance with the applicable Hungarian laws.
In the event of defective performance, the Customer may primarily request repair or replacement, unless the chosen remedy is impossible or would involve disproportionate additional costs for the Operator compared with another remedy.
If the Customer is not entitled to request repair or replacement, or if the Operator has not undertaken or cannot perform repair or replacement within an appropriate period, the Customer may request a proportionate price reduction, repair the defect themselves or have it repaired by a third party at the Operator’s expense, or ultimately withdraw from the contract.
Withdrawal is not permitted for minor defects.
The Customer must notify the Operator of the defect without delay after discovering it. Notification may be sent to the following e-mail address:
XX. Product warranty
In the case of a defect in a movable item, a Customer qualifying as a Consumer may, at their choice, enforce either implied warranty or product warranty claims.
As a product warranty claim, the Customer may request only the repair or replacement of the defective product.
A product is defective if it does not meet the quality requirements in force at the time it was placed on the market, or if it does not have the characteristics stated in the manufacturer’s description.
The Consumer may enforce a product warranty claim within the statutory time limit calculated from the date the product was placed on the market by the manufacturer.
XXI. Commercial guarantee / mandatory warranty
Certain durable consumer goods may be subject to mandatory warranty under applicable law.
If mandatory warranty applies to a given product, its details are contained in the warranty certificate, manufacturer’s information or the applicable legal provisions.
The warranty does not affect the Customer’s statutory warranty rights.
XXII. VIN information and external data sources
VIN-based information, as well as information related to color codes, vehicle types, model years or manufacturer data, may be displayed in the online store, the CarColor mobile application or related online interfaces.
VIN-based information originates from an external service provider. Such data are not generated by CarColor 2000 Kft., are not operated by CarColor 2000 Kft., and the Operator does not guarantee their accuracy, completeness or up-to-date nature.
The VIN search function or VIN-based information interface serves information purposes only. No direct order is placed through the VIN search function.
Manufacturer, model, year, equipment, color or other data displayed on the basis of the VIN may differ from the actual condition of the vehicle, previous repairs, repainting, import market specifics or differences in manufacturer databases.
The Customer acknowledges that before finalizing the order, they must verify the color code, vehicle data and other order data provided. The Operator shall not be liable if the Customer orders a Custom Product on the basis of an incorrect or inaccurate VIN, color code or other data.
XXIII. Automotive color codes and paint differences
Paint mixing based on automotive color codes is performed using professional databases, manufacturer formulas and available color information.
The Customer acknowledges that shade variants, differences by model year, manufacturing tolerances, and differences caused by vehicle use, ageing, UV exposure, polishing, previous repairs or the condition of the clear coat may occur even within the same factory color code.
Paint mixed by color code does not always guarantee a completely invisible match with the vehicle’s current, actual, aged or repaired paintwork.
The Operator shall not be liable for defects resulting from improper surface preparation, unprofessional application, incorrect layer structure, unsuitable drying conditions, incorrect clear coating or improper use of the product.
The Customer must perform a test spray or test application before using the product. If the Customer applies the product directly to the final surface without testing it first, the Operator shall not be liable for the resulting damage.
XXIV. User reviews and comments
The online store may allow product reviews, opinions or comments to be displayed.
The User may publish only lawful, true content that does not infringe the rights of others and does not violate public morals.
It is prohibited to publish content that:

The Operator is entitled to remove content that is unlawful, offensive, false, misleading or endangers its business interests.
User content does not reflect the position of the Operator. The User who published the content is primarily responsible for the legal consequences arising from it.

The User may subscribe to the newsletter by giving separate consent. The User may unsubscribe from the newsletter at any time by clicking the unsubscribe link in the newsletter or by sending an e-mail to the Operator.

XXVIII. Accuracy of information displayed in the mobile application
Color code, vehicle, product, price, stock, opening hours or other information displayed in the mobile application may be for information purposes only.
Certain data in the application may originate from external sources. The Operator shall not be liable for the accuracy, completeness, up-to-date nature or availability of such external data.
If there is any discrepancy between the information displayed in the application and the information displayed in the online store or in the order confirmation, the data displayed in the online store and in the order confirmation shall prevail for the purposes of the order.

XXXII. Liability
The Operator strives to ensure that the online store and the mobile application operate continuously, safely and without errors; however, it does not guarantee that the services will be available without interruption at all times.

The Operator shall not be liable for damages arising from improper use of the products, unprofessional application, improper storage, improper surface preparation, incorrect application or disregard of professional instructions.
